ADDITIONAL TERMS AND CONDITIONS:

The Muse Room photography studio reserves the right to change the current rate at any time, but it will not affect pre‐paid reservations that have already been made.

Payments
The Renter will pay for the rental at the time of reservation. Payments can be made online.

Session Set-up
Please include the time you need to set up and clean up for your session in your reservation. You will need to include time needed for make‐up artists, hair dressers, lighting setup, prop, furniture setup, equipment testing, etc. in your reservation time. IMPORTANT: Time starts at your reservation time, not when your party arrives. Time ends after the entire party leaves the studio area and the studio is cleaned, ready for the next renter. You must leave the studio in the same way it was when you arrived. There is no refund or discount for leaving early. If you have not vacated The Muse Room when your reserved rented time has ended, a late fee payment of $72 per hour (or $50 for anything under 15 minutes) is due by the end of that same day.

Cleaning
After each use of the studio, the renter is required to sweep and mop the floor of any spills or dirt incurred during their rented time and place any trash in a trash can. All surfaces must be wiped clean and tangible items must be put back in their original place. The couch fabric must be kept clean. Please refrain from eating and drinking on the couch and/or putting shoes on the couch. Put lights, cables, props, etc in their designated areas. Please fold and hang any fabrics and garments used. Failure to complete any of the previously mentioned will result in a $100 cleaning fee.
It’s understandable that accidents happen and damage may occur. It is the renters responsibility to inform the owner, Rebecca Evans, of such incidents as soon as possible via social media direct message, email, or phone.

Reservations
Renting the Studio requires a paid reservation in advance. Payment must be made at the time the reservation is made. Reservations must be made at least 24 hours prior to reservation date. Walk‐ins are allowed if staff is available. The Studio lease time and date selected will be reserved exclusively for you once your reservation has been paid for. Reservations are on a first come first served basis. Reservations are best made as far in advance as possible for desired times. IMPORTANT: Include set-up, makeup and wardrobe time in your rental reservation time. Please don’t be late and ask your clients to be on time. There may be a scheduled session after you that may not allow you to go over your reserved time. If there is no session scheduled after you and you stay longer than the time you reserved, then payment at the hourly rate will be due at the end of your session.

Hourly Rates
Hourly rates are based on regular open hours and are billed per hour.

Daily Rates
Daily rates are charged per 8 hours for a full day or 5 hours for a half day. Daily rates are for consecutive hours and cannot be split throughout the day. Daily rates are based on regular open hours and do not include after hours. Daily reservations must not exceed 8 hours.

No-shows
If a renter does not show within 15 minutes of any reservation, it is considered a no-show. No-shows are not refunded, transferred, nor rescheduled and your reservation is forfeited. If the renter’s staff, clients, models, crew members, makeup artists, hair stylists or any other associate of the photographer scheduled to arrive does not show, the photographer is still allotted the scheduled time and is required to pay for that time reserved. The Studio will not be held responsible for photographer’s staff, clients, models, crew members, makeup artists, hair stylists or any other associate of the photographer for not showing up or cancelling. No shows: no reschedule is allowed; all time and funds are forfeited.

Rescheduling
We understand that things happen. In the event the renter must reschedule, the reservation can only be rescheduled 1 time with no cancellation fee or penalty. Upon rescheduling, your paid reservation will transfer to the rescheduled reservation. Rescheduling a reservation must be made at least 24 hours prior to original reservation. Reservations cannot be rescheduled on the day of the reservation. If the photographer cannot or does not show on the rescheduled reservation time, that time is forfeited and cannot be rescheduled again. Funds used to reserve will not be refunded nor transferred. To prevent the abuse of constant rescheduling, we do not allow more than 1 reschedule per event.

Inclement Weather
If the roadways are blocked by official Dept of Transportation or Dept of Public Safety agencies and the Studio is not accessible, there is no refund but the renter will be able to reschedule the same reservation hours to the next available reservation date for no additional charge. The renter is responsible for staying informed on the weather forecast and local events to determine if they should reschedule their reservation in a timely manner.

Cancellation fee
If a cancellation is made 8 or more days prior to a reservation date, a refund will be given. If a cancellation is made 7 or less days prior to a reservation date, no refund is permitted, but a reschedule at a later day is allowed with a $50.00 rescheduling fee. Please understand that the average renter normally reserves several weeks in advance and it is difficult to fill the space with such short notice. Cancellations are not permitted within 24 hours of the reservation date.


Contact Information
It is the renter’s responsibility to ensure The Muse Room and it’s owner, Rebecca Evans, has updated contact information. We will send important Studio information by email and/or text. Please add themuseroomga@gmail.com to your email whitelist to ensure delivery of our emails to your inbox. If the renter opts out or does not provide an email address and phone number, then announcements will not be delivered and the renter risks the possibility of missing essential information to gain entry access to the studio.


Clients
The renter is solely responsible for anyone that accompanies them in The Muse Room and their actions. Any business transactions made with your clients will be between you and your clients only. The Muse Room and it’s owner(s) cannot be held responsible for any disputes that may arise between you and your clients. Everyone must follow the studio rules while in the building.

Connected Service Representatives (Models, Make Up Artists, Hair Dressers, etc.)
It is the renter’s sole responsibility to have a binding agreement with any and all persons whom he/she hires or contracts with, whether verbally, in writing or intent. The Muse Room or it’s owner(s) is not responsible for compensating for any services provided to the renter. The Muse Room reserves the right to trash, donate, or sell items left unclaimed at the studio for more than a week.

Damages and Insurance
The renter is responsible for any damages caused to The Muse Room or any of it’s personal property beyond normal wear and tear. Financial compensation for The Muse Room will be required by the renter to replace or repair items that have been damaged. IMPORTANT: The renter is responsible for arranging insurance (or confirming their hired party has the appropriate insurance) for their personal property against all risks and for your liability to and for your employees and third parties and for maintaining any specific insurance. You have the risk of damage, loss, theft or misappropriation with respect to any of your personal property and liability to and for your employees and third parties. The renter agrees, as a material part of the consideration to be rendered to The Muse Room under this Agreement, to waive any right of recovery against The Muse Room, its directors, officers and employees for any damage, loss, theft or misappropriation of their property under their control and any liability to and for their employees and third parties, including for injuries to their Invitees in or about The Muse Room, and the renter agrees to hold The Muse Room and its owner(s) exempt and harmless and defend The Muse Room from and against any damage and injury to any such person or to such property, arising from their use of The Muse Room from their failure to keep the premises in good condition and repair as provided in this Agreement. All property in The Muse Room is understood to be under the renter’s control.

Liability
IMPORTANT:
In no event will The Muse Room or its owner(s), employees, agents, affiliates or suppliers be liable to guest or any party claiming through guest, for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits, lost data, personal injury or property damage, of any nature whatsoever, arising from the guest’s use of The Muse Room, any content or other materials on, accessed through or downloaded from the marketplace service, or guest’s use of The Muse Room, even if the host is aware or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, and to the maximum extent permitted by applicable law, The Muse Room’s liability to guest or any party claiming through guest, for any cause whatsoever, and regardless of the form of the action, is limited to the amount paid for The Muse Room, in the 12 months prior to the initial action giving rise to liability. This is an aggregate limit. The existence of more than one claim hereunder will not increase this limit. The parties shall indemnify, defend and hold harmless The Muse Room from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys' fees, arising out of or in connection with any use of The Muse Room, or any violation of applicable law, this agreement or house rules.

Keys and Security
Renters will be given a code to access the building key. Any keys for the Space or the Building, which The Muse Room lets you use, remains The Muse Room’s property at all times. The renter shall not make any copies of them or allow anyone else to use them without The Muse Room’s consent. Any loss of keys must be reported to The Muse Room’s owner immediately, and the renter must pay the cost of replacement keys and or changing locks, if required by The Muse Room. The renter shall not place any additional locks or bolts of any kind upon any of the doors or windows of the Space or Building nor make any changes to existing locks or the mechanisms thereof.

Loss
The owner(s) of The Muse Room will do their best to ensure that the studio equipment is fully operational. We will not be held liable for any equipment malfunctions or damages due to any circumstances beyond our control. In the event of a loss of studio equipment, we will not be held liable for any lost wages, commissions, donations, fees, revenue or any additional loss you may incur from such events. This includes, but is not limited to, advertising, transportation, equipment rental and purchases, employee wages and any other expenses you may incur. (Losses include but are not limited to weather related incidents, flooding, electrical outages, damages to the building which would prevent studio operations, evacuations, etc.)

Props
All items used must be returned to their original place in their original condition. All props must be generously wiped down with sanitizing wipes if needed. If blankets or other fabrics, including couches and chairs, used become soiled or dirty during your session, you must inform this to the owner of The Muse Room via phone call, text, or direct message via instagram or email, prior to leaving the studio. Failure to abide by this could result in an additional fee to clean or replace the articles.

Reselling
Reselling or subleasing your time is not allowed. The renter reserving time must be present during his/her entire reservation time. It is not considered reselling or subleasing for assistant photographers. Exceptions are only allowed on a case by case basis determined by Rebecca Evans.

Classes
The Muse Room does not require compensation from anyone attending classes hosted by renters. The studio requires standard rental fees to be paid in advance. If classes are canceled, please refer to our reservation cancellation policy.

Attorney’s Fees
In the event of any breach of this agreement, the party responsible for the breach agrees to pay reasonable attorneys' fees and costs incurred by the other party in the enforcement of this agreement or suit for recovery of damages. The prevailing party in any suit instituted arising out of this agreement will be entitled to receive reasonable attorneys' fees and costs incurred in such suit.

Agreement Between Parties
This agreement shall be governed by the laws of the state of Georgia. Provisions of this agreement may be amended only in writing and signed by both an authorized Studio representative and renter. Each party has read the above agreement and before signing it, has had the opportunity to contact an attorney or other person to assist that party in reviewing the agreement. Each party certifies that she/he understands the agreement and has had the opportunity to ask for an explanation of any term that the party does not fully understand.

Termination
The Muse Room reserves the right to terminate this agreement upon violation of it; the renter must remove all belongings immediately.
For our monthly and extended monthly members; full payment is made up front and is non-refundable. Any hours that were not used within your allotted time frame are forfeited.


Member Scheduling
The member will need to reserve desired studio times at his/her own convenience. Studio time is reserved on a first come first serve basis.
